  Dear Westridge Residents, October 15, 2006:
I have been asked as the current President of the HOA to briefly bring everyone up to speed on current HOA Board activities.

As you can see by an earlier notice announcing next Tuesday's Board meeting, the Declarant would like to remove the current association officers and replace us with his appointed Board members. Two of these appointed Directors are not residents of Westridge Place.

For several years we have been trying to facilitate the transition from a Declarant run HOA, to full homeowner control.

I think the record of achievement of your current Board officers speaks for itself, along with Lance Boyce, Jim Bangert and Anita Anjoubault. (Jim resigned earlier in the year, and Anita and Lance were removed by the Declarant in June and replaced.) We have been deeply involved in setting up a a good governance model, an informative website, posting Board Meeting Minutes, newsletter, balanced budget, financial reporting, required financial reserves, selecting a good property manager, implementing sound ACC guidelines, streamlining and documenting ACC guidelines and approvals, a fine and appeals policy, tree removal procedures and guidance, and many more. Major accomplishments that resolved or improved upon the difficulties of the past.

There are many more issues facing the association to which you need to ensure that your interests as residents are protected. This includes monitoring a $100 million lawsuit filed by a gated community homeowner against the Declarant. While this lawsuit does not involve the HOA, there are many issues raised in the lawsuit that we should monitor.

Unfortunately, due to short notice, Miron and I can not be there next Tuesday, however I believe the meeting will still occur. In that regard, I strongly encourage all residents of Westridge to attend the meeting and voice your concerns directly to the Board members that do attend.

This action will clearly not be in the best interest of the association, and you have a right to be represented at a meeting of this nature by your elected representatives.

  One Pacific Corporation Exercises Power of Appointment, June 2006
The Board of Directors received an email late Sunday afternoon from Rick Bowler informing us that One Pacific Corporation is exercising their power of appointment and asking for the resignations of Anita Anjoubault (homeowner) and Lance Boyce (homeowner) from the Board of Directors. One Pacific is appointing Ray Tatum (homeowner on 9th Circle) and Greg Sellars (non homeowner) to the Board of Directors. They join Mark Benson (non homeowner) as Declarant appointees. They join the three elected Directors: President-Jim Cochran, Vice-President:Miron Washington; Sec./Treas: Catherine Reneau who are all homeowners. One Pacific has also informed the Board of Directors of their intent that elections of new Officers will be held. One Pacific has been informed that, as Declarant, they are obligated to follow the CC&Rs and Bylaws of Westridge Place HOA at all times.

1. Miron Washington and Jim Cochran have been re-elected to two-year terms as homeowner Board members.
2. The Waiver of the 2005 Annual audit was approved.
3. The 2007 Annual Budget was approved by the Homeowners.

     
  ACC - Operation & Review Guidelines
Adopted October 3, 2005
     
  ACC Tree Removal Guidelines:
Given all the concern with the Tall Fir trees, we need to reiterate to homeowners what the requirements are for removing trees. For safety, if an arborist finds a tree that is hollow or has a rotten core and/or visible stress breaks, cracks with heavy sap, these trees need to be removed immediately for safety reasons. The homeowner must provide this evidence to the HOA for our records.

For all other trees, per the CC&R's the homeowner must have two concurring arborist opinions that the tree is a hazard. One of these arborists must be the City Arborist because we are in a tree preservation area and the City must approve any tree that is not an "immediate or imminent safety threat", this is a City Code related to tree preservation areas. These concurring opinions must be sent to the HOA Management company, along with a schedule for removal.

All trees removed, must be replaced by a like tree. The CC&R's do not specifically state what size of tree, however, as tall a Douglas Fir as the homeowner can plant is preferred. Other like pine, fir, spruce and cedars are ok, however, Douglas Firs are native, have the best survivability rate and will eventually replace the canopy that makes our neighborhood visually attractive. People should not be afraid to re-plant with Douglas fir, the issues that led to the current situation are many, however, a planted Douglas fir that matures with its roots intact and minimal trimming will survive wind storms well into the future.

Please forward any conversations or correspondence to the other ACC members, the Board and the management company so that we can keep records of removal and tree plantings. We need to react to the situation as quickly as possible so that homeowners make the right decisions. Overall, we need to preserve as many healthy trees as possible, while addressing the safety issue.
