Fine Schedule and Appeal Process
This fine schedule was revised by the Board of Directors at its meeting on February 18, 2016, and is effective immediately.
As allowed by By-Laws of Westridge Place Homeowners’ Association Article 1,
  1. Upon identification of a violation by a Homeowners’ Association member, the member may report the violation to the Westridge Place Homeowners’ Association (WPHOA) Management Company for action. An officer of the WPHOA or the Management Company may identify a violation and pursue proper action.
  2. The Homeowner who is in violation of the Declaration of Covenants, Conditions and Restrictions of Westridge Place (CC&Rs) will be notified by the WPHOA Management Company, in writing, describing the violation and request the Homeowner to resolve the violation in question within 30 days.
  1. The Homeowner must respond in writing within 30 days to report action taken on the matter.
  2. The Homeowner may request in writing to the WPHOA Management Company for further explanation or clarification about the violation cited within 15 days of the notice.
  1. After the expiration of the 30 day notice with no response by the Homeowner, a fine will be charged based on the Association Fine Schedule adopted by the WPHOA Board of Directors in accordance with WPHOA By-Laws, Article 1, Section 6.8.
  2. All fines are subject to the appeals process described in Bylaws of WPHOA Bylaws Article 1, Paragraph 8.
  1. If a Homeowner does not agree with the issue or violation, or previous resolution proposals, the Homeowner may file a written appeal to the Board, with supporting documentation.
  2. The Board will consider the appeal at the next regularly scheduled Board Meeting. The Homeowner may be present to present his/her appeal to the Board.
  3. The Board will make a final decision.
  1. After 30 days, the WPHOA shall assess a 1% per month penalty on unpaid fines until paid.
  2. Administrative remedies: After exhausting of appeals or failure to comply or failure to pay accumulated fines, the Board may pursue legal action as allowed by the By-Laws and the CC&Rs.
